New UN Convention on Judicial Sales of Ships entering into force: A Step Toward Global Certainty in Maritime Transactions

Today the UN Convention on the International Effects of Judicial Sales of Ships has officially entered into force. The convention introduces a globally coordinated framework intended to enhance legal certainty in cross‑border ship transactions. By ensuring predictable recognition of “clean title”, the convention is set to influence enforcement strategies, financing structures and due‑diligence practices across the maritime sector.

Historically, the legal effects of a judicial auction or court‑ordered sale of a ship have not been consistently recognised across jurisdictions. Although a ship might be sold free of encumbrances under the law of the selling state, some foreign courts allowed renewed arrest to enforce claims that had been extinguished by the sale, and certain ship registries declined to record the transfer of ownership or remove existing mortgages despite a valid court order. This lack of uniformity has created material risk for buyers and has undermined the value of maritime security interests in cross‑border contexts.

The UN Convention on the International Effects of Judicial Sales of Ships introduces a harmonised framework intended to resolve these uncertainties. Under the Convention, a judicial sale conducted in one contracting state must be recognised in another - provided both states have ratified the instrument - thereby ensuring that the buyer acquires the vessel with internationally acknowledged “clean title”. While the regime applies only between ratifying states, it represents a significant step toward a more predictable and reliable system for enforcing maritime claims and facilitating judicial ship sales globally.

We will continue to monitor developments as more states sign and ratify the Convention and assess the practical impact for parties engaging in international ship sale and enforcement processes.
