Adam Birkstrøm Klüver Jepsen specialises in real estate and deals especially with construction law matters, including disputes and commercial aspects of the law. 

Adam acts for a large number of construction-sector players, including owners, contractors and suppliers for the construction industry. Adam deals with risk management and incentives structures in contracts with a view to avoiding any disputes. In connection with disputes, he advises on aspects such as the litigation process and his legal services include pleadings, settlement negotiations and settlement agreements. 

He also acts for building and construction enterprises in cases before the Danish Building and Construction Arbitration Board and he appears before the Danish courts. Furthermore, Adam provides advice within project development. The advice typically relates to the construction of buildings and facilities as well as the obtaining of financing and investments.  

He also assists in drafting tender documents and contract documents.

Recent highlights
  • Adam acted for an owner in a dispute concerning defects in a major construction project. The case involved a substantial claim for damages in respect of 230 flats with various types of defects. 
  • Adam acted for a supplier of building components on the negotiation and drafting of a commercial agreement with a foreign manufacturer of building components, which called for features such as the incorporation into the agreement of targeted incentives structures and LCA requirements under the Danish Building Regulations 2018 (BR18). 
  • Adam acted for a homeowners’ association on a major construction project concerning balconies on the front façade of a property. He advised on potential risks and drafted a design and build contract.
