Mikala Berg Dueholm provides advice to public authorities and private enterprises on all aspects of procurement law and public contracts. 

Mikala heads DLA Piper Denmark’s procurement team. She has a right of audience before the Danish High Courts and is recognised by Chambers as Up and Coming. 

Her clients include the City of Copenhagen, the Central Denmark Region, the Danish Road Directorate, the Danish passenger transportation company Trafikselskabet Movia and the Danish National Building Fund. 

Mikala has a wealth of experience of both EU and national procurement law and advises on all aspects, including procedure, negotiations, contracts, incentive mechanisms, contractual changes, access to documents, disputes and complaints. 

She is particularly experienced in tender proceedings within transport, environment and soil contamination, IT, construction and consulting services. 

Mikala also provides advice to municipalities, regions and government agencies on municipal law and administrative law in connection with tender proceedings.  

She often advises on large and complex matters such as the EU call for tenders concerning the first PPP contract for sewage systems in Denmark and the EU call for tenders concerning the clean-up of Denmark’s largest toxic contaminated site. 

Mikala has also conducted a number of cases concerning the procurement rules before the Danish Complaints Board for Public Procurement and the courts.

Mikala lectures in procurement law at Nohrcon and is a former part-time lecturer in constitutional law at the University of Southern Denmark. In addition, she is a preferred speaker at procurement conferences. 

Moreover, she understands the political machinery and is skilled at operating in politically driven organisations.

Recent highlights
  • Mikala advised the City of Copenhagen on all legal aspects of an EU call for tenders concerning the first PPP contract for sewage systems in Denmark. The PPP contract of an approximate value of DKK 500m was large and complex and to apply for a 30-year period. Her advice also extended to municipal and administrative law in connection with the tendering process. 
  • Mikala assisted the Central Denmark Region in connection with an EU call for tenders concerning the clean-up of Denmark's largest toxic contaminated site, Groyne 42, with a budget of approx. DKK 700m. Her advice spanned all legal aspects of the tendering process, including document drafting, document management, Q&A, negotiations etc.  
  • Mikala acted for the Danish passenger transportation company Trafikselskabet Movia in a case raised by an operator against Movia. The issue of the case was whether Movia had set up the right requirements for authorisations in a call for tenders concerning regular traffic services. Mikala’s client was successful in the proceedings before the Danish Complaints Board for Public Procurement and subsequently before the district court. 
  • Mikala assisted the Danish Agency for Public Finance and Management in a complex and extensive tendering process concerning an IT contract for operation and maintenance, legacy reduction and development etc. of the Danish State’s payroll service system (Statens Lønløsning). The call for tenders was subject to the Danish “location requirement rule”, which stipulates that due to national security, certain data processed in specified IT systems must be stored exclusively in Denmark.
