Kim Rasmussen

Kim Rasmussen deals especially with litigation, arbitration proceedings and commercial contracts.  

Kim has a right of audience before the Danish Supreme Court, is a certified arbitrator and regularly conducts proceedings before the Danish courts and the Danish Arbitration Board.  

He provides assistance throughout the entire proceedings, including on the drafting of complaints and claims, exchange of pleadings, procurement of evidence and witness statements, expert opinions, negotiations and settlement discussions. He also acts as a mediator in connection with disputes, including negotiations of commercial solutions.  

In addition, Kim advises on national and international commercial contracts with a particular focus on supply contracts, sales contracts, trade agreements, project agreements and financing agreements. Moreover, Kim deals with terms and conditions of purchase, sale and delivery and thus has experience of Incoterms 2020. 

Kim is also widely experienced in both financial and operational leasing, including insurance issues. Finally, Kim has experience within financing, spanning credit and loan agreements as well as chattels financing.  

Kim was also formerly a part-time lecturer in civil procedure at Aarhus University.

Recent highlights
  • Kim acted for Abildskou A/S in connection with its conclusion of an agreement with FlixBus. Abildskou A/S sold a part of its business activities to FlixBus and, at the same time, concluded a cooperation agreement providing for Abildskou A/S to operate selected routes in Denmark for FlixBus. 
  • Kim has acted for Microshade A/S for a number of years on the preparation and conclusion of development, production and sales agreements. 
  • Kim has acted for Unilabs A/S for a number of years on the preparation and conclusion of service agreements, non-disclosure agreements and has also provided regular assistance on the wording of specific contractual provisions. 
  • Kim acted for the bankruptcy estate in connection with the bankruptcy of Råhus Construction ApS in 2021. Kim conducted the bankruptcy estate’s case before the court, whose outcome was that the court imposed a disqualification order on the formal as well as on the actual management.  
  • Kim acted in arbitration proceedings for the buyer of an enterprise, who had raised a claim against the seller due to misstatements in the financial statements. The matter was submitted to the Danish Disciplinary Board for Approved Auditors, which confirmed that the financial statements had been incorrectly prepared.
